Terms of service

1. Scope and seller

These Terms and Conditions apply to orders placed by consumers and business customers in the online shop magic-candles.de. Your contracting party is:

Magic Candles, proprietor Anton Maslun
c/o IP-Management #6530
Ludwig-Erhard-Straße 18
20459 Hamburg
Germany
Telephone: +49 176 31034407
Email: info@magic-candles.de

A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person or a partnership with legal capacity acting in the course of its trade, business or profession when entering into a legal transaction.

2. Ordering and conclusion of the contract

The display of products in the online shop does not constitute a binding offer. You can first add the products you want to your shopping cart without obligation. In the cart and during checkout, you can review your selection and your details and correct them using the available editing functions before submitting your order.

By activating the final order button, which clearly indicates an obligation to pay, you submit a binding offer to buy the selected products. If you use an accelerated payment method, you review and confirm your order details within that payment process.

We may accept your offer within two days after receiving your order by sending you an express order acceptance by email, delivering the ordered goods or providing the ordered gift voucher, or requesting payment after you submit your order. If we accept your payment or collect the order amount through the selected payment provider before then, the contract is concluded at that earlier point. Whichever acceptance occurs first determines when the contract is concluded. Merely authorising or reserving a payment does not constitute collection of the payment.

An automatically sent order receipt acknowledgement initially records receipt of your order. It also constitutes acceptance only if its content says so. This does not affect a contract already concluded through any of the actions described above. If we do not accept your offer within that period, you are no longer bound by it.

3. Contract languages and contract text

Contracts can be concluded in German and English. We store the order details. Your order details, the Terms and Conditions applicable to the contract and the withdrawal instructions will be sent to you by email in a form that you can save or print. The legal texts on our website show the current version; your order is governed by the terms agreed when the contract was concluded.

4. Prices and payment

All prices shown are total prices in euros, including statutory VAT and all other price components. Any additional shipping charges are shown in the shipping information and before you complete your order.

You can use the payment methods offered for your order at checkout, including the available methods provided by Shopify Payments, Klarna and PayPal. Where applicable, payments are processed by the payment provider you select. That provider's terms shown during the payment process apply to its payment service.

For payment methods requiring immediate payment, the order amount is collected as part of the ordering process. For payment methods with a separately agreed payment period, the payment terms shown during the payment process apply.

5. Delivery and shipping

We deliver physical goods to the delivery address specified in your order within Germany. Shipping costs €4.90. Shipping within Germany is free for orders with a value of €50.00 or more.

Unless a different delivery period is stated for the particular product, delivery takes 3–5 working days from conclusion of the contract or, where advance payment has expressly been agreed, from receipt of payment. For this delivery period, working days are Monday to Friday, excluding public holidays. Electronic gift vouchers are covered by section 6.

Further delivery details are available in our shipping information. We will inform you without undue delay if a delivery delay occurs. Your statutory rights in the event of delayed delivery or non-delivery remain unaffected.

6. Electronic gift vouchers

Purchased gift vouchers are supplied electronically as a voucher code to the email address provided when ordering. No physical gift card is sent, and there are no shipping charges for electronic delivery. The voucher value shown on the product page is available for redemption once payment has been made and the voucher has been provided.

Gift vouchers can be redeemed during checkout in the online shop magic-candles.de. If the balance is insufficient to pay for the entire order, the remaining amount can be paid using a payment method offered at checkout. Any unused voucher balance is retained. Our purchased gift vouchers have no expiry date.

Voucher balances cannot be exchanged for cash except where required by law. Statutory withdrawal and refund rights remain unaffected.

Consumers also have a statutory right of withdrawal when purchasing a gift voucher. Sending the voucher code by email does not end that right. Further details are set out in the gift voucher section of our withdrawal instructions. Following a valid withdrawal, the corresponding voucher code will be deactivated.

7. Retention of title

Goods delivered remain our property until the purchase price has been paid in full.

8. Right of withdrawal

Consumers have the statutory right of withdrawal. The conditions, time limits, procedure and model withdrawal form are set out in our withdrawal instructions, which distinguish between physical goods and electronic gift vouchers.

9. Statutory rights relating to defects

The statutory rights relating to defects apply. If you have a question about a defect or damaged delivery, contact us at info@magic-candles.de or by telephone on +49 176 31034407.

Please inform us of visible transport damage as soon as reasonably possible. This request helps us handle the matter promptly and resolve it with the carrier. If consumers do not report such damage or report it later, their statutory rights relating to defects and withdrawal are not restricted.

Official EU notice on the legal guarantee

Official EU notice: legal guarantee of at least two years

10. Liability and safe use

Our liability is governed by the statutory provisions.

Candles are a source of open flame. Follow the safety and use instructions on the product, packaging and enclosed information. In particular, never leave a burning candle unattended, keep it away from children, pets and flammable objects, and use a suitable heat-resistant surface. Statutory rights in the event of a product defect remain unaffected.

11. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

12. Applicable law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they habitually reside.
